  • HB 914 passed by the 79th legislature requires disclosure statements concerning gifts to government officers from vendors and potential conflicts of interest. This legislation is effective January 1, 2006. The required disclosure forms were developed by the Texas Ethics Commission. Links to these forms are provided below.

    Conflicts of interest: If a vendor does business with or plans to do business with the District, and is aware of a first degree relationship by blood (consanguinity) or marriage (affinity) with a board member, the executive director, or a family member of either, that vendor is required to complete a “Conflict of Interest Questionnaire”. It is the responsibility of the vendor to obtain and submit the questionnaire to the District. The form must be completed and filed by the vendor with the District within 7 business days of knowledge of the potential conflict.

    In addition, the director or board member is required to file the “Conflict of Interest Questionnaire” if the District is doing business with a vendor and a first degree relationship exists as described above. The form must be completed and filed with the District within 7 business days of knowledge of the potential conflict.

    Gifts received by a government officer from a vendor or potential vendor: The executive or board member must complete a “Local Government Officer Conflicts Disclosure Statement” if the gift(s) received exceed $250 per vendor aggregate value in a 12-month period. The statement must be completed and filed by the government officer with the District within 7 business days of meeting the $250 aggregate threshold. Gifts of food, lodging, transportation, or entertainment accepted as a guest are not included in the $250 calculation and do not have to be disclosed.
